What is a Power Of Attorney?
A Power Of Attorney (POA) is a legal document that authorizes a person to act as Agent for Another (the Principal). The Agent can be anyone of adult age that the principal chooses. The agent is usually a family member who carries the trust and access of the person signing the POA. The reasons for needing a Power Of Attorney are usually age, medical or psychological inability of the Principal to carry out his or her own affairs. Once the Power Of Attorney is done and legalized, the agent can now make important decisions for the owner.
A Power Of Attorney Document will have the contents to which powers will be granted, POA’s can be of various sizes and complexities - depending on how many assets and ongoing legal issues require decision making there are.
Power Of Attorney documents require extra witnesses and their signatures while doing it in front of a Notary Public. A Notary in Florida can notarize POA’s but the Notary cannot serve as one of the witnesses. The witnesses must not also be the agent or anyone else mentioned within the Power Of Attorney itself.
